Engaged or married couples enter into ante-nuptial (also known as prenuptial) and marital (also known as postnuptial) agreements for many reasons, including the following:
- » Previous marriages
- » Inheritances
- » Significant separate assets and/or discrepancy in the assets of the spouses
- » Ages of the couple
- » Stepchildren in the new marriage
Virginia Law allows couples to enter into written agreements before or during their marriage to agree on certain provisions for spousal support and division of property should there ever be a separation and divorce.
If a couple separates, unless one of the prior agreements already exists, another useful document is a separation agreement. This is a wise way for both parties to provide for a fair settlement and avoid significant legal expenses for a contested divorce.
If a divorce does occur, property division at that point should be simplified by the prior drafting and execution (by both parties) of any of these agreements.
If the two parties decide to reconcile, the separation agreement can spell out property ownership and other issues after reconciliation.
It is not wise for parties to try and draft these types of agreements or use some online service. The best option is to hire a qualified and experienced attorney who can also answer questions, particularly as relates to Virginia law.
